We hereby agree with the following terms and conditions and accept to become a customer at “Fusion Shoppe”.
1. You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such content originated. This means that Fusion Shoppe is not entirely responsible for all content that uploaded, posted, emailed, transmitted or otherwise make available via the Fusion Shopping Services.
2. Fusion Shoppe does not control the content posted via the Fusion Shoppe Services and, as such, does not guarantee the accuracy, integrity or quality of such content. Under no circumstances will Fusion Shoppe be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available via the Fusion Shoppe services.
3. You must be at least 18 years of age or above to form a binding contract and are not a person barred from receiving the Fusion Shoppe Services under the laws of the United States or other applicable jurisdiction.
4. All prices, unless indicated otherwise are in US Dollars ($).
5. All prices and availability of products are subject to change without prior notice at the sole discretion of Fusion Shoppe.
6. Fusion Shoppe reserves the right to refuse to service or cancel any order placed for a product that is listed at an incorrect price. This shall be regardless of whether the order has been confirmed and/or payment levied. In the event the payment has been processed by Fusion Shoppe the same shall be credited to your account and duly notified to you by email.
7. In a credit card transaction, you must use your own credit card. Fusion Shoppe will not be liable for any credit card fraud. The liability to use a card fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively on the user.
8. On receipt of your purchase order Fusion Shoppe shall promptly (depending on the mode of payment) forward the order to the merchant. It is the sole responsibility of the merchant to dispatch the product(s) to the User.
9. Any request for cancellations or corrections of orders once duly placed on the site, will need to be discussed with the merchant directly.
10. In the event that a non-delivery occurs on account of a mistake by the customer (i.e. wrong name or address), any extra cost incurred by the merchant for redelivery shall be borne by the customer.
11. Presently, the service(s) of Fusion Shoppe are being offered free. However, Fusion Shoppe reserves the right to charge a fee for any or such facilities.
12. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Fusion Shoppe Service's registration form (the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Fusion Shoppe has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Fusion Shoppe has the right to suspend or terminate your account and refuse any and all current or future use of the Fusion Shoppe Services (or any portion thereof).
13. “Fusion Shoppe” is not responsible for any loss, damage, return, and warranty for any product of any merchant. If any financial or legal damages that occur in course of time for the same, will be borne by the merchant.
14. In order that a legally binding contract can be formed between “Fusion Shoppe” and the customer, the customer is accepting the Terms and Agreements unconditionally by registering to become a customer.
15. No warranty of completion of sale.
16. You acknowledge that “Fusion Shoppe” does not see or examine items that are listed for sale and has no control whatsoever on the actual quantity, quality, safety, legality or the fitness for any purpose of the Item. Fusion Shoppe will not accept or assume any liability whatsoever in respect of the Item.
17. You acknowledge that “Fusion Shoppe” does not accept responsibility for any loss or damage, however caused (including through negligence) In case of any dispute between users or any dispute arising from the use of the Services, “Fusion Shoppe” shall be released from all liabilities claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
18. Each merchant would have different 'Exchange/Return Policy' for their product(s). Customer(s) must read merchant return/exchange policy before buying any product online. Fusion Shoppe does not take responsibility of any return or exchange or refund for product(s) bought through Fusion Shoppe. Customer(s) must contact merchant(s) directly for return/exchange/refund if applicable.
